Actually, studies have shown that it is NOT same as talking to a passenger. The studies my wife has looked at show the "distraction rate" is the same for hands-free as it is for handset use of the cell phone.

That's correct, an unconscious "cruise-control" portion of the brain is driving the vehicle, while the mind is primarily involved in the conversation. Ka-BOOM! Crash time.

I agree, but somehow the original quote was attributed to me in your post, Skid. It should be attributed to Doug 4.7.

I drive about 500 miles per week. We now have a "Hands Free Only" law here in CA. When it first took effect, I saw very few drivers with cellphones in one hand (to ear) driving with the other. Now that a little time has passed, I see many violators.

I have a bluetooth and voice dialing and I still avoid making calls when driving if at all possible.

this is my "mea culpa":
I do like my cel Phone, I feel NAKED when (on very rare ocasion) I had left it forgoten @ my house!
I have verything stored in my cel PH.

on the other hand at begining of last year with my brand new car (less than 400km total) I did rearended someone for picking up my phone that had fallen in the leg area of the pasenger side, forget about insurance, the car didnt have plates!

also I DO talk in my cel while driving but I try to at the begining before the conversation "get to the point" to DRIVE AWAY from the trafic, and PAY MORE ATENTION to driving, looking more rear view mirrors or outside....

now: whenever I see someone w/a handset to the ear, I get real close and blast away the horn, or in a street intersection I DO NOT give way (plus the horn!).
I do get "a blast" when I tease the cel phoners!!! LOL!

I I HAVE A DATE WITH ETERNITY, AND I DON´T WANT TO BE LATE!

I've found I can 'pick-up' while driving (sometimes). If I have any doubts, my cheap little TracFone™ from {forbidden-name}-Mart only rings about ¾-minute before it quits. If I can ignore the juvie in the lane to my left with his flatulent aftermarket exhaust for the 5 minutes it takes him to lose interest in serenading me, I can shine on my little phone's ringing as long as is necessary.

I don't dial while rolling. At significant personal irritation, I have committed a handful of contacts to 'speed-dial,' I think. I've yet to develop any proficiency with such features while sitting in my chair at home, so it will be a while before I mess with any of that, underway. I might resurrect my old, hand-filling Nokia 918 as a lighter-energized, 911-only for vehicular use.

I beg to differ, drinking a soda while driving is not comparable to carrying on a conversation on a cell phone. Granted that anything done while driving is a distraction, the amount of distraction varies tremendously.

Is talking to someone in the back seat just as dangerous?

Per Google LINK no state has an outright ban on all cell phone use. There are some handsfree laws and some segments banned eg bus drivers, novice drivers, etc

I detest laws that legislate common sense but I am afraid that people are just too stupid. Lousy drivers are even worse with a cell phone in their ear. I see near accidents all the time so I guess I come down on the side of outlawing cell use.

Not exactly. I think the phrase is "situational awareness". The person on the other end of the cell phone has no idea what is going on around you as you drive whereas someone in the car does. Now there are exceptions, but in general, that is the reason why cell phone calls are more troublesome than in-car conversations.

I can tell you this, I have had a cell phone since 1991, my first was a Motorola bag phone, the best phone I ever had, but it was analog, so its dead now, and I'm stuck with a tiny little thing that's junk by comparison, for a cell phone.
It worked at greater distances, had no hands operation, larger buttons and was much louder if you wanted. But it was bigger. But for us we also had a little pocket job, and just left the bag phone in the motorhome connected to an outside antenna, and the reception was great. It almost always worked, when the small unit wouldn't. It was always the phone of choice when in the MH. And was much safer to use when driving.

In my travels back and forth to CA, I haven't noticed much of a decline in cell phone use while driving. Guess a lot of people don't care they are braking the law.
