Timeline: bought HTT from RV Wholesalers 10/9. Approved for loan, got all papers signed, sealed, and delivered, drove from Houston to Ohio to pick up trailer. Have yellow paper from Bank listing total amount, interest rate, interest payments, total payments, etc. Also the Bank is listed on my insurance card as lienholder.
About a week after getting home, get a call from Bank to verify my address & phone number. Inquire about direct payments for loan from my checking account (my preferred way to pay) & gal says it will all be in the welcome package with my payment booklet. OK.
Week before T'giving realize I have never received a payment booklet. Call salesman @ RVW that sold me the trailer. He says don't worry about it, occassionally that bank runs late -- I'm sure you'll get it. Yada, yada. Not knowing THAT bank but it being one RVW presumably uses all the time, I take his word for it.
2nd week of December -- I still haven't received payment booklet. Call salesman back. He says well, it's the holiday season but maybe they're waiting for something we should have sent or something got lost in the mail. I'll check on it. He doesn't seem worried in the least.
Next week I call salesman back again. He tells me he'll get Mike to investigate it & see what the holdup is. OK.
FRIDAY @ 2:30 Mike calls @ my work. He says the bank is now denying approving me for financing and what other kind of arrangements can I make to pay for the trailer? WHATTTTT???!!!!!
Supposedly they ran my credit again & are now reniging on the loan. I explain waiting on the payment book & I'll be GLAD to pay. He said he'd have to check into it & he'd get back to me. He hung up & now I'm all worried about this.
Friday was also my last day @ school and now we're out for the Christmas vaca. I was gone this weekend to relatives. I kept checking my home phone to see if Mike had called me back. No messages.
I got home today, still no messages. I went to go get groceries and when I get back there is a NASTY message on my phone from Mike, saying he's called my work and home @ least ten times this weekend & today & NEVER got an answer and he WILL get paid for his trailer one way or another, and then threatening legal action against me.
ALL I WANT TO DO IS PAY FOR THE LOAN ON THE TRAILER!!! They wouldn't have let me leave with the thing if it hadn't been all OK. I WASN'T avoiding his calls -- I'm NOT at work until Jan. 4th. They have ALL my contact info -- including where I work (XXX Elementary) and my cell phone number. He's never tried my cell phone!!
Can the bank DO that?? I mean, let me sign for a loan & give me the approval papers, then 2 months later tell me I DON'T have a loan??? I'm just at a total loss here and more confused than anything.
Hoping this all turns out OK.....

Get a lawyer now....I think in end it will work out in your favor but there will be some hoops to jump through. Is there a Credit Union you can contact work with them?

To echo others, definitely get a lawyer and I think this will work out in your favor. I don't think they can renig on this like they are. Obviously an error in paperwork or communication. Stand your ground, and DOCUMENT EVERYTHING!!! Print out call records if you can to prove "Mike" never tried calling you. Good luck!

I'd tell them to come get the trailer. If you were not approved for the loan it can't show up on your credit report as a default. I'll bet Mike changes his tune.

Many years ago, a similar thing happened to me with a truck I bought. The dealer sold me a loan, said everything was peachy, and sent me on my merry way. A month later, they still hadn't secured bank financing and told me I might need to return the truck. Luckily, they did finally get me a loan and disaster was averted.
It seems that when the dealer finance department gives you a "loan", they're just kind of guessing what the bank will do (then marking it up a little to pad their profit margin). I'm sure that's not true in all cases, but it seemed to be in mine.

I would try calling the bank in question directly and try to find out exactly why this happened and why you were never notified of the denial. You have the signed document in hand. When it comes to banks nothing surprises me anymore as to what they will try to get away with especially in credit cards, fees and consumer loans. You should also check your credit score to see if something new is showing up. I know nothing about the legalities of it all but I would try to resolve it myself before considering a lawyer as that could get expensive real quick. I would exhuast all other options such as getting approved by another bank or CU if you have no luck with this bank. Then the lawyer would be my last option. Good luck.

Save your telephone records and begin writing a diary beginning at
arriving at the dealership the first time w/ dates, times, places, names,
and phone numbers dialed.
IMO Mike is a salesman who is trying to cover his butt.
A letter to the Owner of the Dealership (if not Mike) explaining your situation
and asking for their cooperation, etc, may help keep things from escalating.
Surely they do not want bad press in the local paper and RV magazines
for shady/questionable business practices.
