I may have exhausted all options, but thought I would toss this out in case I missed something....searching for a creative solution.

Oct 21, 2012, have a blowout forcing me and my fiver off road and into the center median cable causing very minor damage to the cable (2 posts)on I-40. The N.C. trooper insists he is issuing me a ticket only to tie my insurance company to the damage to state property. (What the heck is my d.l., ins. co. and acc. report for?)....

The ticket was for Unsafe Tire---laughable, as I have doc showing tire 2 yrs old/27k miles and just had been inspected 3 days prior at Ford dealership. $25 fine and $238 for COURT COSTS for the privilege of not going to court (mail in with plea agreement). Insane.

Called DA office handling and said only option was to make personal appearance or send attorney in my behalf, both cost prohibitive compared to fine/court cost total. They wanted nothing to do with reviewing my docs via correspondence and did not offer an "immediate appearance" option at time of accident when I was close by.

I despise pleading to the deal when I know I am innocent. I do not know if it is "points" against my D.L. and trooper couldn't bother to answer. I am pending response from NC Dmv reference that issue.

Any ideas?

So I am confused by your post. You say that you caused damage to the cable and two posts. So, how is it that you maintain that you are innocent?

Cheapest, least time consuming way out is to pay the fine and be done with it. If they tack points on your license, take your state's defensive driving course that may remove some or all of the points as well as lowering your insurance costs. Online self-paced courses are available for most states, including Texas.

Points won't transfer state to state. The record will show you had a blowout and damaged the cable. Your insurance will pay for the damage. Are those not the facts? Pay the fees and move on. What part of the story are you disputing?
If NC chooses to write the ticket let it be, nothing to loose sleep over.
These things happen as an unfortunate part of living in a civilized society.

NC is just interested in getting there railing fixed by the person who caused the damage vs. fixing it at taxpayers expense. The ticket is their way of expediting the process.

I agree that it could be pricey and raise your insurance rates. To bad there wasn't something like a fix it ticket so at least there would be no ticket charge.

Perhaps the ticket is the glue to tie everything together for the state.

You hit the cable, it did not hit you.
Pay the fine and be done with it.
You could have also been cited for failing to control your vehicle. The trooper gave you a break.

Sounds more like equipment violation than a moving violation. I would mail payment and be done with it.
